Section 1 — Acceptance

These Terms govern your use of www.fortress-siding.com. Accessing or using the Site, submitting a form, or scheduling a consultation constitutes your agreement to these Terms and our Privacy Policy (incorporated by reference).

Section 2 — Site Is Informational; No Binding Offer

This Site is for informational, branding, and marketing purposes and to allow users to request information, quotes, and appointments. NOTHING on this Site constitutes a binding offer, quote, contract, warranty, or guarantee. All work, warranties, guarantees, and pricing are governed solely by the signed build/customer/subcontractor agreement. In any conflict, the signed project contract controls.

Section 3 — Appointments & Communications

Appointment requests are requests only and create no binding obligation to perform work. By submitting your information and checking the consent box, you authorize contact per the Privacy Policy (phone/SMS/email where opted in). Reply STOP to opt out of texts; use the unsubscribe link for marketing emails.

Section 4 — Acceptable Use

You agree not to use the Site for any unlawful purpose; submit false information or impersonate another; disrupt Site servers or networks; attempt unauthorized access; use bots, scrapers, or automated tools; or introduce malicious code.

Section 5 — Intellectual Property

All Site content and the Fortress Siding name and marks are owned or licensed by Fortress Siding, LLC. No copying, distribution, or creation of derivative works without written permission.

Section 6 — Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR ACCURATE.

This disclaimer applies to the Site only; service warranties are governed by the signed build/subcontractor agreement.

Section 7 — Limitation of Liability

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED $100.00.

Section 8 — Indemnification

You agree to indemnify and hold harmless Fortress Siding, LLC from any claims arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights, including reasonable attorneys' fees.

Section 9 — Binding Arbitration; Class Action Waiver

1. Disputes arising from the Site or these Terms shall be resolved by final, binding arbitration administered by the AAA, not in court (except individual small-claims matters).
2. CLASS ACTION WAIVER: You may only bring claims in your individual capacity; no class, representative, or consolidated actions.
3. Arbitration shall be conducted in Lancaster County, PA; governed by the Federal Arbitration Act.
4. OPT-OUT: You may opt out of this arbitration provision by written notice within 30 days of your first use of the Site.

Note: This Section applies to Site disputes only. Construction and service disputes are governed by the signed build contract.

Section 10 — Governing Law & Venue

These Terms are governed by Pennsylvania law. Non-arbitration disputes shall be brought in the courts of Lancaster County, PA.

Section 11 — Third-Party Links

We are not responsible for third-party websites linked from this Site.

Section 12 — Changes

We may modify these Terms by posting updates to the Site. Changes are effective upon posting. Continued use constitutes acceptance.

Section 14 — Miscellaneous

If any provision of these Terms is found unenforceable, the remainder continues in effect (severability). Failure to enforce any provision is not a waiver. These Terms and the Privacy Policy constitute the entire agreement between you and Fortress Siding, LLC regarding use of this Site.
